Activity Terms and Conditions 2018 

1. Cancellations – 24 hours notice is needed to cancel your session for a full reimbursement.
2. Amendments –  24 hours notice is needed to amend your session for a full reimbursement.
3. Windmadness reserve the right to remove you from the session should you be unfit to participate, IE intoxicated in any form, health issues or unfit to do so.
4. All under 14’s must be accompanied by a adult of age 18+
5. Any damages to equipment will need to be re-reimbursed by the client unless deemed to be faulty equipment (which we of course dont have)
6. Life Jackets/Buoyancy aids are mandatory in all our sessions, should you remove them with out permission, you can be asked to leave the session.
7. Abuse to our staff is not tolerated and you WILL be asked to leave the activity area

By enrolling on any of our activities (Manually – automatically – voucher use – Third Party websites/Bookings –  a friend, relative, partner or family booking),

you agree to the following :

In consideration for the activities provided by Explore & Adventure LTD / TA – Windmadness Watersports of Stand Up Paddle Boarding/Kite Surfing/Boarding from and/or utilizing the equipment , ground, school instruction premises and equipment of Explore & Adventure LTD / TA – Windmadness Watersports and in engaging in the sport of Stand Up Paddle Boarding/Kite Surfing/Boarding (ground and water instruction) I hereby understand and agree to this release of liability, waiver of legal rights and assumption of risk and adhere to the following terms:-

1. I acknowledge that Stand Up Paddle Boarding/Kite Surfing/Boarding is an action sport and recreational activity involving travel in three dimensions and such activity is subject to mishap and even injury during participation in the sport.
2. I hereby RELEASE AND DISCHARGE EXPLORE AND ADVENTURE LTD – T/A WINDMADNESS and their officers, directors, elected officials, agents, employees, instructors and owners of equipment and the land used for Stand Up Paddle Boarding/Kite Surfing/Boarding (hereinafter referred to as “released parties”) from any and all liability, claims, demands or causes of action that I may hereafter have for injuries, disability or death, or damages arising out of my participation in Stand Up Paddle Boarding/Kite Surfing/Boarding activities including, but not limited to, losses caused by the negligence of the released parties.
3. I understand and acknowledge that Stand Up Paddle Boarding/Kite Surfing/Boarding activities have inherent dangers that no amount of care, caution, instruction or expertise can totally eliminate. I expressly and voluntarily assume all risk of death of persona injury sustained while participating in Stand Up Paddle Boarding/Kite Surfing/Boarding activities whether or not caused by the negligence of the released parties.
4. I further agree that I WILL NOT SUE OR MAKE A CLAIM against the released parties for damages or other losses sustained as a result of my participation in Stand Up Paddle Boarding/Kite Surfing/Boarding activities.
5. I also agree to indemnify and hold the released parties harmless from all claims, judgments and costs, including attorneys fees, incurred in connection with any action brought as a result of my participation in Stand Up Paddle Boarding/Kite Surfing/Boarding activities.
6. I will take full responsibility for, and hold harmless released parties for, any injury that I may suffer or inflict upon others or their property as a result of my engaging in Stand Up Paddle Boarding/Kite Surfing/Boarding activities.
7. I agree that I will operate the said Stand Up Paddle Boarding/Kite Surfing/Boarding equipment in a reasonable and safe manner so as not to endanger the lives of persons or property of any individual.
8. I have read and understand the above and acknowledge that the same constitutes a release of liability and a waiver of my legal rights and also acknowledgement of the assumption by me of all risks arising out of my engaging in kiteboarding activities.
9. I further represent that this release of liability, waiver of legal rights and assumption of risk shall continue in full force and effect for so long as I engage in Stand Up Paddle Boarding/Kite Surfing/Boarding activities which are in any way connected to or with the released parties.
10. I hereby expressly recognize that this Release of Liability, Waiver or Legal Rights and Assumption of Risk is a contract pursuant to which I have released any and all claims against the released parties resulting from my participation in Stand Up Paddle Boarding/Kite Surfing/Boarding activities, including any claims by the negligence of the Released Parties.
